Motor vehicle accident results in 40-year sentence for OK man

Brian Black, 44, of Cartwright, Oklahoma, was sentenced to 40 years in prison for Aggravated Assault with a Deadly Weapon. After pleading guilty rather than going to trial, Judge Jim Fallon of the 15th District Court conducted a sentencing hearing that resulted in multiple decades of prison for Black.   

On September 15, 2021, the Denison Police Department responded to a major motor vehicle accident on Texoma Parkway. Investigation and witnesses revealed that the defendant, driving a truck, had driven over the centerline and hit a small vehicle head on. The victim, although surviving, received serious injuries and was transported to Parkland Hospital in Dallas. 

Subsequent questioning by officers revealed that the defendant had been using methamphetamine prior to driving.  Methamphetamine was also found in the defendant’s vehicle.  
Testing of the defendant’s blood obtained after the wreck revealed an elevated amount of methamphetamine present in his system. The defendant had previously been revoked on bond and held in jail at the request of the State for repeated violations of the bond prior to sentencing.  

At the sentencing hearing, Assistant District Attorney Nathan Young confronted the defendant with both his lengthy criminal history and his continued use of methamphetamine and alcohol after the wreck.    

“The pain and suffering of the victim and the continued risk the defendant posed to our community drove this sentence,” Young said.  

District Attorney Brett Smith added, “We commend the hard work of the Denison Police Department.  The defendant’s actions put citizens at risk.”  

The case was prosecuted by Young.  Legal Assistant April Butner and Assistant District Attorney Vanessa Vice assisted.
